Jyotir, the ancient teachings can be interpreted in multiple ways, depending upon the philosophy one adheres to (i.e. Advaita, Visishtadvita or Dvaita). However, the birds denote awareness (ordinary/human awareness and Divine) while the tree denotes matter. Knowing or observing can occur only when awareness is present. So the possibility of the third entity here does not arise.
One bird is supposed to be eating the fruit, referring to the soul that enjoys the fruits of its actions whether they be good or bad, while the higher bird stands for God, who observes and derives enjoyment from the actions of the bird on the lower branch, remaining pure and blemish-less at all times.
